DMCA POLICY

Chictendencia (“we,” “us,” or “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at https://www.copyright.gov/, we will respond expeditiously to claims of copyright infringement.

  1. Reporting Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, please report alleged copyright infringements taking place on or through our website by completing a DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

Upon receipt of the Notice as described below, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged material from the website.

  1. DMCA Notice of Alleged Infringement (“Notice”)

Your Notice must be a written communication that includes substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed (e.g., a link to your original work or a clear description).
  3. Identification of the material that is claimed to be infringing and that is to be removed, including the exact URL(s) on our website.
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and an email address.
  5. A statement that you have a “good faith belief” that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
  1. Counter-Notification

If you receive a notification that your content has been removed due to a copyright complaint, and you believe that the material was removed by mistake or misidentification, you may submit a Counter-Notice. Your Counter-Notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located.
  1. Repeat Infringer Policy

Chictendencia takes copyright infringement seriously. It is our policy, in appropriate circumstances, to terminate the accounts or access of users who are repeat infringers or who are repeatedly charged with infringement.

  1. False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorney’s fees.
